Preface:

“Golden Eagle Lottery” and “SKGF TRADING (2002) Co. Ltd” take VERY seriously the safety of this platform against any type of fraud, scam or illegal behaviour.

If you see or hear a user, BUYER or SELLER, that is committing an illegal usage of this applicaton or the platform, we encourage you to contact us to relay any type of information.

Notes:

  • “Golden Eagle Lottery” is an online platform for BUYERS and SELLERS of Thai Government Lottery. It is owned and managed by “SKGF TRADING (2002) Co. Ltd”.
  • Downloading the application and using it, means that you fully agree on terms and conditions states here after.
  • “Golden Eagle Lottery” and its mother company “SKGF TRADING (2002) Co. Ltd” are not in any ways SELLERS of lottery tickets, quota holder, or trader of lottery tickets.
  • All tickets available on “Golden Eagle Lottery” are owned by individual Lottery Ticket SELLERS. With or without quota from the “G.L.O.” (Government Lottery Office).

Terms and Conditions for SELLER

  1. In case you sell a winning ticket, you are obliged to pay to the winner the prize. You agree to pay to the BUYER direct by bank transfer the winning amount using the “QR Code Proptpay” generated, or send the physical ticket to the BUYER. All the informations are found in the TRANSACTION detail in SALES section.
  2. It is only the SELLER (you) responsibility to keep the ticket sold on line in a safe place.
  3. The ticket sold and paid online on “Golden Eagle Lottery” application are virtually owned by the BUYER but the SELLER (you) is responsible for the custody of these tickets.
  4. In case the SELLER (you) looses a winning ticket it is personally responsible to pay the winner.
  5. In no case “Golden Eagle Lottery” and “SKGF TRADING (2002) Co. Ltd” are responsible for a lost or stolen ticket.
  6. When the SELLER (you) “scan out” a ticket during the negotiation process (TRANSACTION section) with the BUYER, the SELLER (you) confirms that the SELLER (you) is still holding that ticket.
  7. During the negotiation process, if the SELLER (you) receives the payment within the due time from the BUYER, the ticket is considered sold and owned by the BUYER.
  8. In case the SELLER (you) for any reason is unable to pay a winning ticket that he sold online on “Golden Eagle Lottery” application, within 48 hours from the win, the management of “SKGF TRADING (2002) Co. Ltd” will use any legal means to locate the SELLER (you) and report the case to the police, or to the competent authority in the matter.
  9. The SELLER (you) accepts in this terms and conditions, that if unable to pay a winning ticket, this constitute a number of a serious criminal offences such as theft, online fraud and scam, and all other crimes applicable in these cases.
  10. All communications between SELLER (you) and BUYER must happen on the TRANSACTION section of the “Golden Eagle Lottery” application. Exchange of information such as payment negotiation, bank account numbers, and others OUTSIDE the TRANSACTION section of “Golden Eagle Lottery” application cannot be used as proof or testimony in case of dispute.
  11. If the TRANSACTION section is used for criminal purposes, “SKGF TRADING (2002) Co. Ltd” will report to competent authorities any illegal usage.
  12. The SELLER (you) understand and accept that in case the winner of a ticket sold is unable to contact him or the management of “SKGF TRADING (2002) Co. Ltd” is unable to locate him, the management of “SKGF TRADING (2002) Co. Ltd” will use Social Media platform to locate him. Any action on social media to locate a delinquent seller cannot be considered defamation.
  13. Privacy: all datas collected during registration process are securely stored in “Golden Eagle Lottery” server and are not disclosed to any third party. However, in case of delinquent behaviour the datas will be used to track down the account. In case of request of Thai Government authorities, “SKGF TRADING (2002) Co. Ltd” will hand over any personal data of the SELLER.
  14. Any falsified transaction or attempt of SCAM in any way or meaning, will end in the account termination and direct communication with the local police, or to the competent authority in the matter.
  15. At the next day of every draw event, you will receive an invoice to pay for the sum of the tickets sold, which at the current day of this Terms&Conditions is 4THB. This amount can change in the future. We use this amount to pay all the services that enable this platform to be active and up and running.

Terms and Conditions for BUYER

  1. In case you hold a winning ticket purchased online on “Golden Eagle Lottery” application, the SELLER can directly send you the winning via “QR Code Proptpay” generated or you can ask the SELLER to provide the physical ticket. All the informations are found in the TRANSACTION detail in WALLET section.
  2. You agree that, when you use “Golden Eagle Lottery” application, you are buying lottery tickets from registered independent SELLERS and you pay directly to them via “QR Code Proptpay” generated during the TRANSACTION.
  3. In case the SELLER does not pay you a winning ticket, “SKGF TRADING (2002) Co. Ltd” will do everything possible to locate the SELLER and report the fact to the police, or to the competent authority in the matter.
  4. In any case, “Golden Eagle Lottery” and “SKGF TRADING (2002) Co. Ltd” and its management, are not liable for a winning ticket not paid.
  5. “Golden Eagle Lottery” and “SKGF TRADING (2002) Co. Ltd” has full record of every SELLER operating on the platform and conduct regular due diligence and background checks on the SELLERS.
  6. All communications between SELLER and BUYER must happen on the TRANSACTION section of the “Golden Eagle Lottery” application. Exchange of information such as payment negotiation, bank account numbers, and others OUTSIDE the TRANSACTION section of “Golden Eagle Lottery” application cannot be used as proof or testimony in case of dispute.
  7. If the TRANSACTION section is used for criminal purposes, “SKGF TRADING (2002) Co. Ltd” will report to competent authorities any illegal usage.

Limitation of Liability:

To the maximum extent permitted by law, “Golden Eagle Lottery” and SKGF TRADING (2002) Co. Ltd, including its directors, executives, employees, agents, or related service providers, shall not be liable in any event for any direct, indirect, special, incidental, or punitive damages arising from or in connection with the use of the platform, transactions between buyers and sellers, or the non-performance of obligations by one party.

The company makes no warranties or guarantees regarding prize payments, ticket delivery, or the fulfillment of obligations by vendors or buyers. Any assistance provided by the company shall not constitute a guarantee of outcome or an assumption of liability on behalf of any party.

Disclaimer of Warranties:

The “Golden Eagle Lottery” platform is provided “as is” and “as available” without any warranties, express or implied, including but not limited to warranties of accuracy, completeness, continuity, security, or fitness for a particular purpose.

The company does not guarantee that the service will be free from errors, delays, interruptions, technical malfunctions, or other force majeure events.

Force Majeure:

The company shall not be deemed to have breached the contract and shall not be liable for any damages arising from the failure to comply with the terms and conditions due to force majeure events, including but not limited to natural disasters, fire, flood, earthquake, war, riot, terrorism, suspension of banking services, PromptPay system services, internet network services, power outages, actions of government agencies, or any other event beyond the company’s control.

Account Suspension or Termination:

The company reserves the right to suspend or terminate the account of any buyer or seller, in whole or in part, without prior notice if the company deems that there is reasonable cause to believe that the user has violated these terms and conditions, applicable laws, or engaged in fraudulent, deceptive, or misuse of the platform.

The suspension or cancellation of such account does not affect the company’s right to take legal action or claim any damages that may arise.

Governing Law and Jurisdiction:

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Kingdom of Thailand.
Any disputes arising out of or relating to these Terms and Conditions shall have jurisdiction over the Thai courts.

Severability of a contract:

If any provision or statement within these Terms and Conditions is determined to be unlawful, invalid, or unenforceable, in whole or in part, the remaining provision or statement shall remain in force as if such unlawful provision had never existed.

Waiver:

The Company’s failure to exercise or enforce any of the terms and conditions herein shall not be deemed a waiver of rights and shall not affect the Company’s right to exercise such rights at a later date.

Entire Agreement:

These Terms and Conditions, including any reference documents herein, constitute the entire agreement between the Company and the User regarding the use of the “Golden Eagle Lottery” platform and supersede any prior agreements, negotiations, or understandings, whether oral or written.

Language:

These Terms and Conditions may be provided in multiple languages. In case of any difference or conflict in interpretation, the Thai version shall prevail.
